Joshua Weiss has built a unique practice pairing litigation with high-level government relations work, along with a broad appellate practice.

He represents a broad range of clients in federal and state courts, administrative and regulatory enforcement proceedings and informal dispute resolution processes. Joshua also advises clients on matters of business strategy, regulatory compliance, licensing, internal investigations and corporate governance in heavily regulated industries such as banking, finance, gaming and construction. His clients range from large, multinational corporations and privately held companies to nonprofit entities and elected officials.

Clients appreciate Joshua’s shrewd perspective and approach. In adversarial contexts, Joshua leverages his considerable experience as a litigator to achieve favorable outcomes; and when offering strategic advice, he utilizes keen business sensibilities and political experience to help clients navigate complicated and sensitive situations, including novel questions of law.

Joshua also maintains a robust pro bono practice. He has represented private companies and nonprofits in both litigation and regulatory matters, and he frequently works with Denver’s Project Safeguard to seek protective orders on behalf of victims of domestic violence.

Representative Matters
  • Counsel to Serratoga Falls, LLC, which is owned by a local private equity company, and an individual executive in defense of seventeen claims brought in the Division One Water Court in Greeley, Colorado, which sought over $750,000 in damages, disgorgement of profits, and injunctions preventing water use and property development in a 500-home subdivision in Larimer County. Our team defended against Plaintiffs’ claims brought and filed a counterclaim to obtain court permission to underground an open ditch running through the property. After a seven-day bench trial, the Court dismissed all of Plaintiffs’ seventeen claims, approved the proposed underground pipeline, and awarded attorneys’ fees and costs jointly and severally against Plaintiffs and their attorney.

  • Successfully defeated numerous claims of discrimination, retaliation, and other torts through a four-day jury trial in federal court. Former Director of Human Resources for a professional services agency alleged claims of discrimination and retaliation and Title VII and the Equal Pay Act. Jury returned a verdict finding no discrimination or retaliation, and only awarded a token amount of damages in connection with a limited subset of the plaintiff’s defamation claims.

  • Litigating matter of constitutional interpretation regarding Colorado’s Independent Ethics Commission.

  • Representing nationwide debt settlement company in regulatory inquiry initiated by the Colorado Attorney General.

  • Successfully obtained six-figure verdict in bench trial involving breach of contract, breach of duty, and violation of Colorado’s Trust Fund Statute.

  • Representing multinational, privately held company in business disputes with former distributors.

  • Obtained dismissal with prejudice of complaint by student loan borrower alleging various forms of fraud.

  • Successfully obtained six-figure verdict, plus trebled damages, in bench trial involving a contractor’s violation of Colorado’s Trust Fund Statute on a real estate development project.

  • Counsel to a national gaming company in matters including government contracting, regulatory compliance, political guidance, and strategic business advice.

  • Advising actual and putative nominees to various political appointments.

  • Counsel to an international cosmetic company regarding regulatory compliance issues in connection with new product development.

  • Represented nutritional supplement company in employment lawsuit involving former high-level executive.

  • Successfully defended lawsuit brought against ski resort in southwest Colorado.

  • Counsel to a major labor union in connection with regulatory inquiry involving a state agency.

  • Successfully resolved dispute between publically traded company and former employee involving trade secrets and other contractual disputes.

  • Successfully represented specialized oncology treatment center in complex commercial dispute.

  • Counsel to a public pension regarding regulatory compliance, fiduciary duties, and outside counsel matters.

  • Represented school district before Colorado Supreme Court in election law and campaign finance dispute.

  • Successfully defended nonprofit policy organization in election law dispute involving compliance with Colorado campaign finance laws. Achieved complete dismissal of all claims.

  • Advised health care organizations regarding False Claims Act compliance issues.

  • Represented major, publicly traded hospitality company in complex commercial litigation involving property management, fiduciary duties, and life-safety engineering.

  • Counsel to Gaia in the $145.7M sale of its branded fitness equipment and apparel business to Sequential Brands and Fit for Life.

  • Successfully obtained protective orders for multiple pro bono individuals in matters involving domestic abuse, stalking, and harassment.

  • Advised technology company regarding antitrust and related strategic acquisition issues.

  • Successfully assisted non-profit child care program in licensing transactions, investigations, and disputes with state regulatory agency.

  • Representing individuals in Denver-area real estate dispute.

  • Successfully represented three mortgage originators in licensing investigation by a state regulatory agency. Achieved complete dismissal of the investigation, protecting all mortgage licenses at issue.

  • Representing publically traded company in employment dispute with former executive.

  • Regulatory and compliance counsel for large regional bank related to hemp-related business and service providers deposit accounts.
